By law, only attorneys may prepare property transfer documents, but there are title and escrow companies available to handle escrows and escrow instructions. Conveyance of fee-simple property is by warranty deed; conveyance of leasehold property, which is common throughout the state, is by assignment of lease. Condominiums are everywhere in Hawaii and may be fee simple or leasehold. Sales of some properties, whether fee simple or leasehold, are by agreement of sale. Mortgages are the security instruments. Hawaiians use judicial foreclosures rather than powers of sale for both mortgages and agreements of sale. These foreclosures take 6-12 months and sometimes more, depending upon court schedules. Title companies issue ALTA owner’s and lender’s policies and make numerous endorsements available. Buyers and sellers split escrow fees. Sellers pay the title search costs and the conveyance tax. Buyers pay title insurance premiums for the owner’s and lender’s policies. Property taxes come due twice a year, on February 20th and again on August 20th.
Hawaii is a deed conveyance state, with the Hawaii Bureau of Conveyances (BOC) responsible for recording all conveyance documents. In Hawaii, a conveyance occurs when a real estate title or deed is transferred, but it isn't official until it has been recorded with the BOC. The BOC, a state agency, maintains records of deeds, encumbrances, and other documents related to a property's ownership history.
To transfer a deed in Hawaii, both the current and new owners must sign the deed or lease assignment in the presence of a notary public. The document must then be recorded with the BOC or Land Court, and a Conveyance Tax Certificate must be submitted along with payment of any required taxes. Documents that do not meet the state's recording standards will be rejected by the BOC.
Hawaii is also an escrow state, meaning that real estate attorneys are not required for closing transactions. However, due to the complexities involved, it is customary and legally advisable to hire an attorney or a Investor Friendly Title Company. In Hawaii, the closing process is generally managed through escrow, which is usually provided by title insurance companies. Escrow services can also be offered by trust companies, lenders, Hawaii attorneys, or real estate brokers. Signed documents and funds must be placed in escrow 3 to 5 days before the closing date, and buyers typically receive the keys before noon on closing day.
